On October 7, 1978, Allen Mike Atchak was convicted of five counts of leaving the scene of an accident involving injury without stopping to render aid (hereinafter failure to render aid). After sentencing, Atchak brought this appeal, in which he contends, first, that the trial court erred in instructing the jury and in regulating final argument and, second, that his conviction must be reversed because of prosecutorial vindictiveness.
